Terms of Use

Please read these Terms of Use ("Terms") carefully before using Motion Graphics ("the Service"), operated by Motion Graphics ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Motion Graphics is a service that turns artwork you supply (logos, illustrations, still frames, storyboard panels, sketches and similar visual material) into short animated video clips, based on motion direction you provide. The Service runs in your web browser, with the underlying AI processing performed by third-party infrastructure providers on our behalf.
2. Eligibility
You must be at least 16 years old to use the Service. By using Motion Graphics, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian.
3. Acceptable Use
You agree not to use Motion Graphics to create, upload, share, or distribute any content that is:
- Illegal or violates any applicable laws or regulations
- Abusive, hateful, threatening, or discriminatory
- Sexually explicit, pornographic, or containing nudity. This includes, but is not limited to, non-consensual intimate imagery ("revenge porn"), digitally generated intimate imagery of real persons, and any sexual content involving minors
- Promoting violence, terrorism, self-harm, or harassment
- Misleading, fraudulent, or defamatory
- Infringing on the intellectual property rights of any third party, including logos, illustrations, brand assets, characters, or other artwork you do not have the right to use
Rights in uploaded artwork. You represent and warrant that you own, or have the necessary permission to use, all artwork you upload to the Service. If your artwork depicts an identifiable individual, you must have a lawful basis to use their likeness. You must not use the Service to harass, stalk, shame, or violate the dignity of any person.
Zero tolerance for sexual content. We operate a strict zero-tolerance policy for sexually explicit or pornographic content. Any account found uploading, generating, or attempting to generate sexual content, particularly non-consensual intimate imagery or any content involving minors, will be immediately and permanently terminated without notice. We may report such activity to the relevant law enforcement authorities.
You further agree not to:
- Use automated tools, bots, or scripts to access the Service or any of its endpoints
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Circumvent any security measures, rate limits, or access controls
- Resell, sublicense, or redistribute the Service without our prior written consent
- Interfere with or disrupt the integrity or performance of the Service
We reserve the right to suspend or terminate any account, without prior notice, if we reasonably believe these Terms have been violated.
4. Content Ownership
Your content. You retain full ownership of the artwork and text inputs you upload. By using the Service, you grant us a limited, non-exclusive, revocable licence to process your content solely for the purpose of generating the animated clips you request. We do not claim any ownership of your uploaded content.
Generated clips. The animated clips generated by the Service are yours to use, including for commercial purposes, provided you comply with these Terms and all applicable laws.
Our content. The Motion Graphics name, logo, website design, user interface, and underlying technology are our intellectual property and may not be copied, modified, or used without our prior written consent.
No AI training. We do not use your uploaded artwork or generated clips to train AI models.
5. AI-Generated Content Disclaimer
Content generated by the Service is produced by artificial intelligence and may not be an accurate representation of any real person, place, or event. Generated content is intended for personal and creative purposes. You acknowledge that:
- AI-generated content may contain artefacts, distortions, or unexpected results
- We do not guarantee any specific quality, style, or outcome of generated content
- You are solely responsible for how you use and distribute generated content
- Generated content should not be used as evidence or for any legal, medical, or official purpose
6. Payments and Pricing
All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy.
- Credit-based pricing. You purchase credits that are used to generate clips. Prices are displayed at the point of purchase and may change at any time.
- Currency. Prices are displayed in your local currency where available. The final charge is determined at checkout.
- No subscriptions by default. Unless explicitly stated, purchases are one-time transactions. There are no recurring charges.
7. Refunds
Motion Graphics provides digital goods that are generated on demand using paid AI infrastructure.
- After generation begins. No refunds are available once AI processing has started, as computational resources have been consumed.
- Service failure. If the Service fails to deliver a clip due to a technical error on our side, you will receive replacement credits at no additional cost.
- Unused credits. Unused credits remain in your account and do not expire.
- EU consumers. By initiating a generation, you consent to immediate performance of the service and acknowledge that you lose your right of withdrawal under the Consumer Rights Directive once processing begins.
8. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding the availability, reliability, accuracy, or quality of the service
- Warranties that the service will be uninterrupted, error-free, or secure
We do not guarantee uptime, availability, or that any particular feature will remain available.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) the total amount you have paid us in the three (3) months preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100).
- In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Motion Graphics, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Content you upload, generate, or distribute using the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable laws or regulations
11. Termination
- By you. You may stop using the Service at any time. You may request deletion of your account and data by contacting us.
- By us. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that may harm the Service, other users, or third parties.
- Effect of termination. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to Sections 8, 9, 10, 12, 13, and 14) will survive.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. This choice of law does not deprive you of any mandatory consumer protections afforded by the laws of your country of residence.
13. Dispute Resolution
Informal resolution first. Before initiating any formal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 45 days.
Binding arbitration. If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the London Court of International Arbitration (LCIA) under its rules then in effect. The arbitration shall be conducted by a single arbitrator in London, England, in the English language. The arbitrator's decision shall be final and binding.
Class action waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
Exceptions. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims within the jurisdiction of a small claims court may be brought in such court.
Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first using the Service. If you opt out, disputes will be resolved in the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Motion Graphics regarding the Service and supersede all prior agreements and understandings.
16. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you (such as a notice on the website).
